Agreement to these terms
These Terms of Use ("Terms") apply to your use of the Foundations Athlete website and any pages we run that link to these Terms (the "Site"). "Foundations Athlete," "we," "us" and "our" mean Foundations Athlete of Scottsdale, Arizona.
By using the Site, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.
Who can use the site
You must be at least 13 years old to use the Site. If you are under 18, you may use the Site only with the involvement of a parent or guardian, who agrees to these Terms for you.
Using the site
You may use the Site for your own personal, non-commercial use. You agree not to:
- break any law or violate anyone's rights while using the Site
- give false information, or sign up someone else without their permission
- copy, scrape or harvest content or data from the Site with automated tools
- try to hack, disrupt, overload or get unauthorized access to the Site or its systems
- upload or send viruses, spam or harmful code
We may suspend or block access to the Site for anyone who breaks these Terms.
Intellectual property
The Site and everything on it, including the Foundations Athlete name, logos, the FA mark, the Foundations Athlete Workbook Series, written content, lessons, graphics, photos, product designs and videos, belong to Foundations Athlete or its licensors and are protected by copyright, trademark and other laws.
You may view and share links to the Site. You may not copy, reproduce, sell, distribute, modify or create derivative works from our content, workbooks or logos without our written permission. If you buy a workbook, it is for your own personal use, and that purchase does not give you any right to copy, resell or share it.
Waitlists, preorders and purchases
Joining a waitlist is free and does not require a purchase. Products shown as "coming soon" or "Dialin’ It Up!", including apparel, the workbooks and the FA Home Base app, are not yet available. Descriptions, images, prices and launch dates may change before launch.
When preorders or purchases open, they will be handled through a checkout page, and the terms shown at checkout (including pricing, shipping, returns and refunds) will apply to that order. Payments will be processed by a third party payment processor such as Stripe.
Educational content
Content on the Site is for general educational purposes only. It is not financial, tax, legal, investment or medical advice. Please read our Disclosures.
Links to other sites
The Site may link to other websites, such as social media, sign up forms and partner sites. We don't control those sites and aren't responsible for their content, policies or practices. Your use of them is at your own risk and subject to their terms.
No warranties
The Site and its content are provided "as is" and "as available," without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Site will always be available, error free or secure, or that the content is complete or current.
Limitation of liability
To the fullest extent allowed by law, Foundations Athlete and its owners, team members, mentors and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, opportunities or goodwill, that result from your use of, or inability to use, the Site or its content, even if we were told such damages were possible.
Some states don't allow certain limits on liability, so some of these limits may not apply to you.
Your responsibility
You agree to defend and hold harmless Foundations Athlete from any claims, losses or costs (including reasonable attorneys' fees) that come from your misuse of the Site or your violation of these Terms.
Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules. Any dispute relating to these Terms or the Site will be brought in the state or federal courts located in Maricopa County, Arizona, and you agree to the jurisdiction of those courts.
Changes to these terms
We may update these Terms from time to time. When we do, we'll change the effective date at the top of this page. Using the Site after an update means you accept the updated Terms. If any part of these Terms is found unenforceable, the rest stays in effect.
